6 - Processing of Personal Data

6.3 With your express consent it may be carried out for market analysis and statistics: marketing and for analysis and definition of profiles and preferences; the legal basis for processing is the consent of the data subject.

6.4 With your consent it may be carried out for the communication of data to third parties as specified in section 9 below for the performance of marketing activities; the legal basis for processing is the consent of the data subject.

6.5 It may be aimed at identifying authors of any unlawful acts only in case of specific requests and on behalf of the competent authorities; the legal basis for processing is the protection of the controller’s rights in relation to legal obligations.

6.6 This site uses services and interactions with external platforms to offer the best browsing experience. These services and external platforms may collect, for the Data Controller, information that is always anonymous and never identifying, regarding user behaviour. Likewise, such services and external platforms may collect some user data, governed directly by their own privacy settings.

6.7 The data collected for the purposes referred to in article 6.1 will also be processed to promote services to users who have already used them, by sending periodic informational and/or comparison communications by e-mail; the legal basis for processing is the legitimate interest of the Data Controller, aimed at updating interested parties who have already used the services about offers relating to similar services, in compliance with the provisions of article 130, paragraph 4, of the Privacy Code, without prejudice to the right of data subjects to object to the processing at any time.

7 - Duration and Modification of Data

Processing with regard to modification and duration:

7.1 is carried out by means of the operations or sets of operations indicated such as: collection, recording and organisation; processing, including modification, comparison, interconnection; use, including consultation, communication, storage, selection, extraction; blocking of communication, deletion, destruction; security, protection, including accessibility, confidentiality, integrity, safeguarding;

7.2 is carried out using electronic or otherwise automated means, with the entry and collection of data in electronic databases owned by MF through which the operations listed in point 7.1 are carried out;

7.3 is also carried out by integrating and enriching the collected data with other freely and legitimately available data, through the use of non-electronic tools and organised in paper archives;

7.4 is carried out directly by the organisation of the controller, as well as possibly by third parties for the provision of services to customers.

7.5 The data collected for the performance of instrumental activities in relation to the purposes indicated may be transferred abroad in accordance with the rules provided by current legislation, adopting all appropriate precautions to guarantee an adequate level of protection of such data. Data will be processed by persons in charge or authorised persons appointed by the controller to carry out activities instrumental to the purposes described above. In particular, the data may be made available to third-party companies that perform outsourced activities on behalf of MF, to companies that provide commercial information and are authorised to access public offices, registers and bulletins, and to banks for the purposes provided by law. The data provided by the data subject may be used for consultation of legitimately accessible databases, useful for updating, correcting and integrating the information already provided and to verify possession of the requirements for access to specific benefits and advantages. Furthermore, personal data may be disclosed to third parties and Public Administrations in order to comply with contractual obligations and the law. Data will be retained for the time strictly necessary in relation to the purposes pursued, taking into account legal obligations and the limits provided by law regarding data deletion. In particular, the retention period is limited to the period in which the user is active or until they withdraw consent to processing.

8 - Provision of Data

Without prejudice to the data subject’s personal autonomy, the provision of personal data may be:

8.1 compulsory based on law, regulation or community regulation;

8.2 strictly necessary for the activation and execution of the services offered, as well as for the fulfilment of tax and accounting obligations;

8.3 optional for the purpose of carrying out information, marketing and promotion activities towards the data subject. This means that any error in providing data deemed mandatory may result in the controller being unable to ensure the appropriateness of the processing to the contractual terms for which it is carried out, as well as the failure to match the processing results to obligations imposed by law.

8.4 We also specify that in the event of providing data and consent, at any time you may exercise the rights provided in the following section “Rights of Data Subjects” and that any consent given in relation to the receipt of messages by traditional or automated means may be revoked or limited to only one of the communication channels indicated above.

8.5 The possible refusal by the data subject to provide personal data implies, in the cases referred to in point 6.1, the impossibility of using the services offered by the portal. In the cases referred to in points 6.2, 6.3, 6.4, it does not entail any consequence on existing or in-progress legal relationships, but precludes the possibility of carrying out information and promotion activities of any other initiatives towards the data subject.

9 - Management and Disclosure of Data

9.1 In relation to the purposes referred to in point 6.1, data may be communicated to Partner/third-party companies for the activation of the requested services.

9.2 With your express consent, personal data may be communicated to affiliated and/or controlled companies, to MF’s commercial partner companies for marketing purposes;

9.3 with your express consent, personal data may also be communicated to third-party companies, clients, contracting parties or partners of MF so that, acting as independent data controllers, they may carry out commercial communications via the web, post, mailandfriends.com, telephone (SMS, MMS, telemarketing). Such third parties (whose updated list is always available on request from the Data Controller) belong to the following categories of goods and services:

  • Leisure: editorial, tourism, sport, collecting, photography, hobbies, communication and entertainment, art, music;

  • Distribution and commerce: electronics, computing, imaging and sound, fashion, accessories, clothing, textiles, bazaar, cosmetics and hygiene, chemicals, pharmaceuticals and biotechnology, agri-food, supermarkets, beverages, office supplies, furniture;

  • Automotive: products and services related to cars, commercial vehicles, cycles and motorcycles, trucks, mechanics and metallurgy;

  • Energy and water: products related to electricity, hydrocarbons, gas, water and utilities;

  • NGOs and associations: products and services related to non-profit organisations, foundations;

  • Education, training, instruction, universities;

  • Communication and services: advertising agencies, marketing agencies, event agencies, consulting, advertising, PR, advertising sellers, media centres, telecommunications, market research; mobile marketing agencies;

  • Ecology and environment;

  • Construction, civil engineering and real estate products/services: construction, decoration, home, design, real estate agencies;

  • Trade fairs and events;

  • IT, Internet, e-commerce sites.

To know the detailed list of third-party companies to which data is communicated write to [email protected], we will provide you with an updated list of partners and clients to whom data may be transmitted. Any further communication beyond those indicated above and any further dissemination will take place only with your explicit consent.

9.4 Data may therefore be communicated, transferred or licensed with your express consent to individuals and/or legal entities belonging to the categories described above for the same purposes referred to in this information. Such parties will act as “independent controllers” or “processors”. The data provided may be transferred to countries within the European Union and to non-EU countries in order to meet the purposes indicated above.
